In August of 2018 I purchased a townhome in Molalla, Oregon. During the home inspection, a belly was identified in the sewer line, which allowed for 20+ feet of standing water and grease to remain in the pipe. The sellers agreed to have the sewer repaired prior to closing on the sale of the home. The sellers, unknowingly to me, hired River City Environmental (RCE) to complete the sewer repair and entered into contract with them. It was later explained to me the sellers did not have liquid cash on hand to pay for the work, so an agreement was made between them and RCE to pay for the job with the proceeds of the home post-closing. Unfortunately, the sellers never paid RCE for the work they had done.
For the past three years I have received periodic demand notices from RCE for payment owed to them by the sellers they went into contract with. After receiving each demand letter, either myself or my realtor reached out to RCE to explain the situation, and how I did not order the work, did not sign any contract for the work, and that I purchased the house after the work had been completed. Each time RCE’s response has been they were just trying to make waves in hopes the sellers would do the right thing and pay their outstanding bill. RCE representatives have even suggested to me that I contact the sellers, who are complete strangers to me, and put pressure on them myself. The representative also told me they found I was liable to pay the outstanding bill because I, “Benefited from the work that was done.” Once again, I did not order the work to be done by RCE, did not know who the sellers hired to do the work, and did not sign any contract with RCE to have the work done. Everything was ordered by the sellers as a condition of the sale.
I no longer own the home in Molalla, and have since moved. RCE has tracked myself and my family to our new residence to issue the latest demand notice. They are stalking me despite knowing I am not the party they went into contact with.
As of today (6/14/2023) I have been served with paperwork from the Small Claims Department of Multnomah County, Oregon. RCE has listed the sellers, their realtor, my realtor, and myself as defendants in a $10,512 lawsuit. RCE is intentionally choosing to ignore the facts of who they entered the contract with and are now attempting to drag uninvolved parties through the court system. Their behavior is unethical and unbecoming of a professional business.
