Biggest a/c condensation water leak up-sale I have seen as a Real Estate Broker in 30 years. Technichian said, the evaporator coil is broke & is on a recall list & defective due to a class action lawsuit, gave me a website about a case in a neighborhood was not our neighborhood & not our builder & not part of any lawsuit, & continued to state our broken a/c part is defective & recalled & refused to replace the part. I contacted our HOA to inquire any prior or PENDING litigation as the technician reported, & contacted the a/c part manufacturer & the Federal consumer protection agency in charge of product defects & recalls with no part recall & no product defect recorded for this a/c part. The technician said Home Warranty will not pay for the part to be fixed, your homeowners insurance will not pay for repair, & basically “screwed”. He continued- “we can fix & order a “new” part for you… & since your other evaporator coil is “likely” (currently working, not broken) we will only replace both coils because we can’t do “one without the other”.” 1st quote $7800, & only if we replaced both coils “today” would discount a few hundred dollars. For obvious reasons we chose the next option, we asked for written estimate. He refused several times but after asking for proof he had been out to our home to verify no repair was performed since we paid the $75.00 hw fee, we need proof of the issue to present to the warranty company. He did not give a written estimate but stated the part was defective with no costs to fix & left. The cost is today is lower $6000+. AHS contract states on their website: American Home Shield® offers home warranty plans that cover parts of up to 23 appliances & systems, &if we can’t repair your covered item, we’ll replace it.

It is a horrible thing when it is over 100 degrees outside, we purchase a home warranty for our valued homes with hopes the day does not come when we are hit without a/c heat due to a breakdown and to find out after paying for the warranty for over 5 years @$600.00/year the warranty company sends out this representation. My husband is 56, is a Stage IV colon cancer patient, received chemotherapy later on the day the technician came out last Friday, he is still so sick and will be from side effects for 10-12 days, with no a/c, and no results except “pay the “uncovered” vendor fees & required amount” or get nothing is unsettling. My heart goes out to homeowners who have made a claim on their home warranty & received this type of response & treatment from vendors. We take pride in homeownership, & whether or not we can or can’t “afford” or even “look” like we can afford more, is not reasonable to make untrue representations. We all are seeing the effects of the economy so when quoted a fee for labor and parts, get the repairs in writing on the company’s official estimate sheet or letterhead and ask for a license number, ask for why the part requires repair, get a second and third opinion and most importantly- check out the company’s license status with the State of Nevada’s Contractors Board and find out if there are any complaints or disciplinary action against the Licensee. Be sure to follow the State’s guidelines when hiring a licensed contractor. The Department of Insurance at the State of Nevada website is also a great tool available for those making home warranty claims for the service products they advertise and represent to the public.
